SAN ANTONIO – A man is accused of throwing his girlfriend’s dog and a cat out of an apartment window while they were arguing.

Fernando Morgan, 46, was arrested by San Antonio police after he was seen flinging two animals into the parking lot below the apartment complex.

According to the arrest warrant, the incident occured at the Warren Inn Village apartments off Magic Drive and Fredericksburg last week. Morgan and his girlfriend got into an argument and she told him to leave. He became angry and took his frustration out on the animals, states the affidavit. 

Witnesses told Animal Care Services that Morgan threw the 6-year-old dog, named Ruby, once down a stairway and once out of a second story window. Ruby landed on the girfriend's vehicle and the impact shattered the windshied. 

A cat, named Midnight, suffered only minor injuries and has been placed up for adoption.    

The ACS clinic said Ruby has extensive injuries with a cracked pelvis, cracked ribs and two broken legs. After Ruby receives the care she needs, she will most likely be transferred to a rescue group for adoption.

In Texas, animal cruelty is a felony charge and punishable by a $10,000 fine and up to 10 years in jail.
