SAN ANTONIO — Members of the Texas House will hear a bill today that would allow cities to continue banning plastic bags.

Ten cities have already passed local ordinances to ban the bags.

House Bill 3482 would clarify the rules for allowing cities to implement bag bans.

The proposal, by Rep. Gina Hinojosa, D-Austin, comes in response to a key August court decision now under appeal.

The Fourth Court of Appeals sided with merchants and who argued the bag ban in Laredo on single-use bags is illegal because it is pre-empted by state law regulating solid waste disposal.

Supporters of the bill will gather at the capitol today pushing the legislation that they say would help cut down on pollution in the state.

Meanwhile an opposing bill sits in the Senate.

That bill would outlaw all existing bag bans and prevent future ones.
