The former Pittsford man who had a murder charge dismissed in the killing of his father will remain in federal custody for at least a few more weeks. 

A bail hearing that was originally scheduled for Wednesday morning has now been pushed back to October 19.

Tan was taken into custody Friday on a federal indictment as he crossed the border from Canada to the US. 

Tan is a Canadian citizen and has been living there, according to his attorney.   

Tan pleaded not guilty at his arraignment Saturday in Syracuse. 

The three-count indictment is in in relation to the 12-gauge shotgun and ammunition prosecutors say were used in the killing of his father back in February 2015.

Tan is accused of receiving the gun and ammo with intent to commit murder and manslaughter. 

The other two counts accuse Tan of lying to a Walmart employee during the purchase of the weapon. 

Prosecutors say a friend of Tan's helped in that purchase. The friend has never been charged.

Tan was tried for murder, but the jury was unable to reach a verdict and the judge dismissed the charges. 

Tan's attorney says he and his client were 'shocked' by this latest arrest.
