Embattled Rochester City Court Judge Leticia Astacio has been indicted by a Monroe County Grand Jury.

Astacio was indicted on one count of attempted criminal purchase or disposal of a weapon, a Class D felony.

This stems from an incident where Astacio is accused of trying to buy a shotgun from the Dick's Sporting Goods in Henrietta in April.

Seneca County District Attorney Barry Porsch says Astacio knew she was prohibited from possessing a shotgun.

She'll be arraigned on October 1.

The judge's attorney Mark Foti says he's disappointed, but adds that he's ready to challenge the charge in court. He added that he believes the charge is “inconsistent with the law.”

 Astacio appeared before the state court of appeals in Albany last week to appeal a decision by the Judicial Conduct Commission to remover her from the bench.

That decision is not expected to come down for several more weeks.
