The family of a Lancaster teacher who died after a boat crash is taking legal steps toward a possible wrongful death suit.

Attorneys with Rosenthal, Kooshoian & Lennon LLP confirm they're representing the wife of Eric Pryzkuta.

The 43-year-old was boating with two friends on Lake Erie on the night of May 12th when they crashed into a break wall near the Buffalo Small Boat Harbor. The other two men were rescued that night.

Helicopters and dive teams spent ten hours searching the water before they recovered Pryzkuta's body.

Lawyers say they've started court proceedings to preserve evidence from the crash.

There's no word on when they could file a notice of claim or who they'll be filing against.

The Erie County DA's office is still investigating Pryzkuta's death.

Before the crash, he spent 20 years teaching at Lancaster Middle School.

Lawyers representing the family released a statement on Friday, saying in part:

"On behalf of Mr. Pryzkuta's family, we have initiated court proceedings to discover and preserve the evidence in this case from the various police agencies and authorities that responded to the scene, including the individuals involved, the boat involved, and the break wall involved. We are investigating the circumstances and the possible pursuit of a wrongful death cause of action against all responsible parties."
