ROCHESTER, N.Y. -- A decline in business has a local restaurant on the verge of closing its doors for good.

Mom's Margios Diner at the Port of Rochester owes the City of Rochester nearly $15,000 in unpaid rent according to the city.

Co-owner Jeffrey Scott says he has asked to renegotiate the lease but the city has been unwilling restructure the agreement.

Scott says he would like to pro-rate his rent so it's higher in the summer and lower in the winter, when business is down.

"I want to stay here. I want to be with the revitalization of the Port of Rochester. Charlotte is hurting, and if I leave, there's another business gone out of Charlotte," said Scott.

The city says it sent a 10-day notice to cancel the lease on December 8. 

That notice requires occupants to vacate the premises by December 18 or the city could begin the eviction process.
