ROCHESTER, N.Y. — A Rochester woman who pleaded guilty to threatening to shoot up East High School will not serve any jail time.

Abigail Hernandez, 21, was originally charged with two felony counts for making terroristic threats. The court decided that she deserved a lesser sentence because they believe she is not a threat to society.

Hernandez was arrested and charged with making threats on East High School's Facebook page on February 15th. It happened just one day after the massive school shooting in Parkland, Florida. 

Tuesday, Abigail Hernandez pleaded guilty to making a false report which is a misdemeanor. She has been sentenced to three years of supervised probation.

Her lawyer says she has received about 200 letters of support from people across the country. Some of the letters came from administrators and teachers from the Rochester City School District. 

All in all, the prosecution and the defense agreed that the former Edison Tech student has learned her lesson.

Hernandez is an immigrant from Mexico and she is also facing deportation.

“We think this is in the interest of justice for many reasons and that goes to Abigail as a person and who she is and who she was represented to us to be based upon the letters that we reviewed from the people that knew her best,” said prosecutor Gregory Colavecchia.

“We as a community should take it upon our self to reach out and really go to bat for Abigail to show that she is not the person that should be deported or face these dire immigration consequences," said Michael Geraci, Hernandez’s attorney. "She is a part of our community. She is someone that seeks to be a part of our community and to give back to our community.”

Now that this case is over Hernandez will face another case, about her illegal immigration status. She is due back in federal court Wednesday morning for a status hearing.
