ROCHESTER, N.Y. — A Rochester man admitted in court Thursday morning to selling heroin to a Gates man who fatally overdosed back in January.

Brian Saez, 26, pleaded guilty to criminal negligent homicide. He faces two to four years behind bars after taking responsibility for the death of 33-year-old Sean Vaniderstine.

Gates police say Saez sold heroin to Vaniderstine approximately one hour before he overdosed.

Saez is the second person in the past year to plead guilty after being charged by Gates police with criminally negligent homicide in connection to an overdose death.

"Today is a small victory for all of the different victims who are out there," said Gates Police Chief James VanBrederode. "If you look at the obituaries in the paper, the names continue to appear. This thing has not slowed down. If you're a drug dealer, you're playing Russian Roulette, and we will come after you. I think this case shows that we are serious about that."

Saez is scheduled to be sentenced on July 19th.
