Jim Rogowski has been removed from the Cheektowaga Town Council.

A county court judge announced Tuesday that Rogowski violated his oath of office and must resign his position.

In February, Rogowski was arrested after allegedly chasing his wife’s vehicle, violating an order of protection she filed against him. He was charged with menacing and criminal contempt.

At the time, fellow council member Brian Nowak called on Rogowski to resign.

Rogowski’s wife is now divorcing him and, earlier this month, he pleaded guilty to the order of protection violation.

The judge said pleading guilty to that crime meant Rogowski automatically gave up his council seat.

Rogowski, however, fought to keep his seat and, after refusing to resign, the town filed suit against him.

Rogowski said he has never neglected Cheektowaga’s citizens.

He wanted voters, not a judge, to decide whether he’d stay on the council.

Rogowski’s attorney says he will be filing an appeal soon, adding that Rogowski didn’t commit an offense that requires him to leave office.
