SPRINGVILLE, N.Y. — Erie County Sheriff’s deputies were called to the Country Fair on Route 39 in Springville Sunday night when 34-year-old Nicholas Krencik was said to have fired off two shot gun rounds in the parking lot after he had walked around inside the gas station with a sawed-off shotgun. 

Shortly after deputies arrived Krencik confronted the deputies with the weapon.

When he refused to drop the gun deputies fired their weapons, hitting Krencik in the chest.

He was taken to an area hospital and is in critical condition.

Sheriff Tim Howard says Krencik was not trying to rob the store and his motivation is unclear. 

Krencik had just been paroled after serving time for a criminal weapon’s possession charge.

He was staying with a female friend who was the owner of the shotgun. She told deputies it was not sawed off when he took it. 

Krencik has not been charged for this incident because the investigation is ongoing and he is still in critical condition.

None of the 12 people inside the store at the time were injured.
