The man accused of hanging a dog from a tree in Jamestown is out of jail.

The District Attorney's office confirms Robert Overton Jr. was released on his own recognizance.

He was able to do so because he was not indicted within the 45-day-required time period.

But the DA’s office says Overton could still be indicted this year and faces up to two years in jail.

The 47-year-old is accused of hanging a pit bull from a leash and nylon rope in the area of Hallock and Palmer Streets in late November or early December.

The dog was found in April.

Since then, the Chautauqua County Humane Society has offered information to pet owners about how to surrender pets they can no longer care for. The county also has created an animal abuse registry to ensure people convicted of an animal-related crime will be prohibited from owning animals.
