The Federal Energy Regulatory Commission deals another setback to the Consitution Pipeline project.

Constitution argued that the New York State DEC did not act in time in denying a water quality certification, thus waiving its right to do so. FERC ruled that the state acted in a reasonable time, and a second application was filed by Constitution less than a year after one dating from May 2014.

Governor Andrew Cuomo says the pipeline presented a threat to the environment. He issued a statement that reads in part: "I commend the Federal Energy Regulatory Commission for ruling in favor of New York's efforts to prevent this project from moving forward."

"In New York, we will not relent in our fight to protect our environment and ensure a cleaner, healthier future."
