PERRY, N.Y. — A retired Wyoming County Sheriff's Deputy is charged with second degree murder.

Wyoming County District Attorney Donald O'Geen says 60-year-old Joe Mlyniec was arraigned Wednesday night in connection with the shooting death of 32-year-old Robert Irvine III at his home in Perry.

“What we know is they are acquaintances. I mean they are not strangers to each other, but I know investigators are out today and in the days ahead to learn more about that relationship," O'Geen said.

O'Geen says Mlyniec called 911 himself to report the incident shortly before 6 p.m. Wednesday. He was taken into custody without incident shortly thereafter.

Mlyniec was arraigned in the Wyoming County Courthouse Wednesday night. Mlyniec is being held in the Wyoming County Jail.

He is scheduled to appear in Warsaw Town Court Monday night. The legal proceedings will occur in Warsaw instead of Perry because the Perry Town Judge is familiar with Mlyniec and has recused himself.

Mlyniec retired from the sheriff's office in 2008 after a 20-plus year career. He was hired as a part-time deputy in 2009, but then resigned in 2013 and hasn't had an affiliation with the office since then.

Officials say there is no conflict of interest and they feel comfortable handling the case.

“We have examined that, we have had those conversations both internally and externally with the district attorney and we are more than confident that this investigation will be done thoroughly, professionally and to the nth degree,” said Wyoming County Sheriff Gregory Rudolph.

Mlyniec is also a Perry Town Board member.

“The people are shocked, with him being well-known in the community and having an event like this happen, it's very unfortunate,” said Town Supervisor, Jim Brick.

Mlyniec is due back in court on March 12th.
