UTICA, N.Y. -- A group of Utica residents continue to push for term limit changes in the city, and now it looks like their fight is heading to court.

They want term limits for elected officials restricted to eight-years instead of the current 12, and they want the public to be able to vote on it. The limit was increased from 8 to 12 last year.

Tuesday, the group presented a second-petition to the city clerk, but was told it is too early to have it certified. The clerk says by the time it can be, it will be too late to get it on November's ballot.

The city attorney agrees but, an attorney representing the group does not.

"Our position is the City Clerk's obligation is to certify these signatures within 20 days and that the two-month time limit, which is in a separate paragraph, does not apply to the City Clerk," said Attorney Mark Wolber.

The group, head by a former Utica Common Councilman, now plans to take the case to court.
