This week, Governor Cuomo signed a bill to create a State Commission on Prosecutorial Conduct.

The committee will be able to investigate and penalize prosecutors who act unfairly or it could clear prosecutors accused of wrongdoing. 

The commission, the first of it's kind in the nation, will be made up of eleven members.

However, the Onondaga County District Attorney says the law is unnecessary and unconstitutional. 

William Fitzpatrick points to  a unit that is already focusing on prosecutors.

And he believes the bill gives the chief judge more responsibilities and violates the separation of power.

"I've never seen anything like it in my life,"  Fitzpatrick said. "How could you sign a statue that's unconstitutional? Why don't you sit down and come up with what I think is a very reasonable solution to a nonexistent problem."

Fitzpatrick says he will join other DA's to fight the law before it goes into effect next year.
