UTICA, N.Y. -- The case against the Utica College student accused of making phone call threats to the school is heading to trial.

Fahrudin Omerovic appeared in Oneida County Court on Friday morning. He turned down a plea deal.

The 23-year-old is charged with two-counts of making a terroristic threat.

The plea deal included the two-charges running consecutively, putting Omerovic in prison for 10 years.

It would have also taken care of unrelated charges of second-degree identity theft and petit larceny.

Omerovic's attorney is comparing this to another phone call threat case in which the person got one-year probation and a fine, so he believes there's a better way to settle this.

"There needs to be deterrence, but there also needs to be fairness so people make mistakes, we need to get to it a just result. But with a 10 year offer, it's difficult to navigate through what I see as a just conclusion," said Omerovic's attorney John Raspante.

Omerovic is scheduled to be back in court on May 24.
