We've seen several videos showing travelers being questioned about their citizenship right here in our region.

The latest one surfaced this week.

It was shot at the Regional Transportation Center by Sheila Sicilia, a member of the Syracuse Immigrant and Refugee Defense Network.

The video shows a Border Patrol Officer going from person to person asking, "Are you a U.S. citizen?"

For some, the agent even asks for identification. 

When the officer approached Sicilia, she responded, "I don't have to answer that."

She says often people are not aware of their rights. 

"It seems to be kind of a grey area about Border Patrol even having that big of presence, but people do have the right. Everybody has fourth and fifth amendment rights whether they're U-S citizens or not. Everybody has a right not to answer. Everybody has a right to refuse a search without a warrant, but people just don't know it," said Sheila Sicilia, Syracuse Immigration and Refugee Defense Network.

A lawyer tells us law enforcement can have these check points as long as it is within 100 miles of the U.S. border.

A Border Patrol spokesperson said, “For decades, the U.S. Border Patrol has been performing enforcement actions away from the immediate border in direct support of border enforcement efforts and as a means of preventing trafficking, smuggling and other criminal organizations from exploiting our public and private transportation infrastructure to travel to the interior of the United States."
