ONEIDA COUNTY, N.Y. -- The father of a child who died in a fire wants to take legal action against the Yorkville Volunteer Fire Company and the Village. His attorney, David Longeretta said it is not intended against the firefighters, but the Yorkville "policy-makers."

The fire killed 41-year-old Heather Mishlanie and her 6-year-old daughter Taylor Mishlanie last January.

Taylor's father, Christopher Mishlanie, who is also Heather's ex-husband, believes more could have been done to save the two.

His attorney has filed a notice of claim.

In particular, Christopher Mishlanie believes firefighters at the scene should have called the Utica Fire Department for mutual aid, instead of other volunteer departments in the area.

Utica is one of the closest departments, and the notice claims firefighters could have been on scene in a minute to a minute and a half, compared to several minutes for Yorkville and other departments to fully arrive.

The notice also claims Yorkville did not properly inspect and maintain its fire hydrants.

Mishlanie is seeking unspecified damages for his daughter's death.

Spectrum News reached out to both the fire department and village. The Yorkville Fire Chief declined to comment. We haven't heard back from the Village attorney yet.

Mishlanie and his attorney are also seeking information from the Oneida County Department of Emergency Services and responding agencies. That information includes text messages, emails, and phone calls concerning the fire.
