A former elementary school teacher from North Syracuse schools is heading to trial.

James Ball is accused of shooting and killing his brother-in-law on the Fourth of July.

Investigators say the two men got into a fight, leading up to the shooting.

Ball allegedly fired four shots from a 22-caliber rifle. Two of those bullets hit 40-year-old Christopher Ross in the back.

Despite his reputation as a well-respected teacher at Smith Road Elementary School, the DA's office says the evidence justifies the murder charge he's facing.

As to whether or not a plea deal is on the table, it's still unclear.

"He's got a great support system out there,” said Defense Attorney Michael Spano. “You can tell he's a very well respected man in this community, and he has been for a long time."

"We will look at every aspect of this case,” said Senior Assistant District Attorney Michael Kasmarek. “We will review every piece of evidence and we'll entertain any information that we can get regarding all the parties involved."

Ball's trial date has been set for September 10. He is charged with 2nd-degree murder and 1st-degree manslaughter.
