ROCHESTER, N.Y. — So far Governor Cuomo has not called a special election to fill Rep. Louise Slaughter's vacant congressional seat.

Now seven voters in the district are trying to force the issue.

They've filed a lawsuit in federal court claiming the governor is denying their constitutional right to representation by not calling a special election in timely fashion. The lawsuit claims it's something he has a responsibility to do.

They are asking the judge to either require Cuomo to stop "unnecessarily" delaying an election proclamation, or to rule the election be held on June 26th at the same time as the federal primary.

There are four Democratic candidates running for the seat in that primary.

The winner will face a Republican candidate in November.

The governor's office did not immediately return a request for comment regarding the lawsuit.
