Dr. Robert Neulander returned to court Wednesday as he seeks to have his murder conviction overturned two years after he was found guilty of killing his wife and trying to cover it up.

Neulander, of Dewitt, was granted a hearing in front of the Court of Appeals in Rochester, which heard oral arguments in the case.

Last year, his first attempt at an appeal was denied by judge Thomas Miller, the judge who oversaw his trial.

Now Neulander has a new lawyer, and is taking the appeal to the state level. 

Neulander's new defense attorney argued that the previous lawyer, Ed Menkin, made several missteps in the trial and that Neulander was deprived of his constitutional rights. They're looking for a new trial in the 2012 death of Leslie Neulander.

Neulander's team had previously appealed to a lower court about the juror's behavior, but was overruled.

Leslie Neulander's death was originally ruled accidental after she slipped and fell in the shower, but investigators charged Robert Neulander after further investigation.

Neulander has maintained his innocence, and both his and Leslie's family have stood by his side.

He is currently serving a 20-year-to-life prison sentence at Elmira Correctional facility.

There is no time frame for when a decision may come from the appellate court.
