There's a legal loophole that could bar the state from prosecuting anyone pardoned by President Trump. Now, state Attorney General Eric Schneiderman is trying to close it.
Schneiderman wants lawmakers to clarify the state's double jeopardy law, which protects people from being prosecuted repeatedly for the same allegations.
He says the current law could be used to fight state charges by anyone who's received a pardon for similar federal charges.
In a letter to state lawmakers, Scheiderman says, "Recent reports indicate that the President may be considering issuing pardons that may impede criminal investigations. This is disturbing news...because it would undermine public confidence in the rule of law."
State Senator Todd Kaminsky said he will introduce legislation to fix the problem.
