The Troy police officer believed to be behind an assault at a little league baseball field is back in the spotlight.

Darren Ayotte says he was assaulted by Officer Dominick Comitale back in September at the Twin Town Little League. While Ayotte says his physical injuries healed, he says he still worries about payback.

"I believe he's a threat to me and my family at this point. I would ultimately like to see him fired from his position,” said Ayotte.

He says it was newly released dashcam video that makes him worry about retaliation.

Comitale could be heard telling responding officers, "That's alright, payback’s a [expletive.]”

"When we listened to what was said on the tape, was very alarming and reinforced our feeling that we need order of protections in place," said Ayotte.

Since the alleged attack, the officer was faced with a harassment violation. However, Ayotte and his attorney, Lee Kindlon, says there needs to be more severe repercussions in place, especially with it happening in front of children.

"There's baseball games going on, there's kids milling about the entire place. My 8-year-old son saw the whole thing."

Kindlon and Ayotte will be filing a civil suit against the officer, which would be Comitale's fifth against him. Kindlon says the previous four have been settled and it's believed to have cost the city around $175,000 in payouts.

"This pattern of misconduct is something Troy Police not only knows about, but simply because they're not doing anything to discipline or relieve him from the force, this is something that needs to stop,” he said.

Spectrum News is told, at this time, Comitale is on paid administrative leave. The Troy City Police Department says the internal investigation is still active.

The Mayor's Office says it will not comment on a personal matter.

Kindlon also says the Rensselaer District Attorney's Office is mishandling this matter. District Attorney Joel Abelove is up for election Tuesday, and did not immediately return a request for comment.
