The Saratoga Springs planning board has voted unanimously to approve a special use permit for a controversial Code Blue shelter proposal, despite a pending lawsuit brought by a group of city residents to block its construction.

Shelters of Saratoga can't move forward on a permanent shelter on Walworth Street until a judge rules. The organization says it would provide more than 40 beds to those who need a warm place to sleep.

The Franklin Street residents' group said it is disappointed in Thursday night's decision, and added it has demonstrated several times that there's a site for a shelter in a more mixed-use area of Saratoga Springs.

The planning board is also asking the City Council for a recommendation and to review a Neighborhood Advisory Council document on the proposal.
