WATERVLIET, N.Y. -- Police say one person is dead and another person is in custody after a late night standoff in Watervliet. 

Waterliet police said Michael J. Fox, 49, has been charged in the death of his neighbor, Brandon Sherwin, 29. Sherwin was found dead inside Fox's home on 4th Avenue near 23rd Street, the apparent victim of a homicide. There's no word yet on how Sherwin died.

Authorities responded to the area around 9 p.m. Friday for a report of shots fired. A female witness told police the incident happened inside the 4th Avenue home. Police found damage consistent with shotgun projectile in the door of the common hallway. Officers then established a perimeter to ensure the safety of the surrounding area. 

"I can understand based on the sounds and the motives that were used last night were it could be alarming to any member of the public, but I can assure the public there was never any outside threat to public safety. We were totally confident that the people we were looking for were inside that building and we ensured that we kept the perimeter at least outside of that area very safe," said Lt. Mark Spain.

After failed attempts at negotiations a tactical team made entry into the home and took Fox into custody and where Sherwin's body was found.

Fox faces a number of charges including menacing, criminal possession of a weapon and attempted murder. He is in Albany County Jail on no bail.

Police said the motive is unclear.
