David Sweat has been denied an appeal to have his case heard again in court.

Sweat, along with fellow inmate Richard Matt, escaped from Clinton Correctional Facility in Dannemora in 2015. Matt, originally from Tonawanda, was killed by police; Sweat was taken into custody two days later, ending a three-week-long manhunt. 

He was moved to Attica Correctional Facility late last year. 

Sweat now claims he wasn’t given enough time to talk with his lawyer about his options before pleading guilty to his escape. The judge rejected this argument.

The court says, in its decision Thursday, that it weighed “the serious nature of the offense, the trauma and fear instilled in the community during the weeks it took to apprehend the defendant and the considerable resources and expense involved in his recapture” before ruling against his appeal.
