The New York SAFE Act makes it illegal to have more than seven rounds of ammunition in a clip.

But Erie County's District Attorney will no longer prosecute people who break that part of the law.

District Attorney John Flynn said a federal court of appeals struck down that part of the law more than two years ago.

The U.S. Supreme Court declined to hear the lawsuit, and now Flynn said he’s deferring to the lower court’s decision. 

Flynn says there are 23 pending cases related to that clause. The charges in those cases will be dropped.

"I don't make policy determinations on laws. That's a legislator’s job,” he said. “I enforce the laws that are on the books and I enforce the laws that higher courts and courts of law tell me are either constitutional or unconstitutional."

Flynn said people who have pleaded guilty or been found guilty of carrying too many rounds can't appeal the verdict but they can file a motion to present additional facts.

Those motions will be considered on a case-by-case basis.
