BUFFALO, N.Y. — Kaleida Health is prepared take the Buffalo School Board to court over its recent decision to award its school nursing contract to another provider. 

Kaleida representatives and their lawyers gathered in front of the board's bid committee Wednesday to present a formal appeal of that decision.

This all started back on January 4, when bids for all potential nurse providers were due to the district by 11 a.m.

Kaleida entered its electronic bid at 10:57 a.m., but its hard copy didn't make it in until about 20 minutes later.

District rules state the bid shouldn't have been accepted, but according to new documents (see below), not only was Kaleida's bid accepted, it was initially considered alongside other eligible ones.

And it wasn't until the end of April, more than four months later, that the district told Kaleida its bid had been rejected.

Last month the school board voted to accept a nursing bid from two other companies.

"I think we're optimistic that at least the district will acknowledge that mistakes were made. Whether or not they reject the bid altogether and start over remains to be seen,” said Kaleida Health Chief of Staff Michael Hughes.

The district is not commenting on this pending decision.

It has five to seven days to respond to Kaleida.

If Kaleida's appeal is rejected, after 13 years of service all 77 of their nurses will have to go.

Should that happen, the nurses will still have jobs: they’ve all been offered positions at Oishei Children’s Hospital.
