BUFFALO, N.Y. — Erie County leaders are once again urging the state Senate to pass the Child Victims Act.

The most recent version of the bill extends the statute of limitations in criminal cases from 23 years to 28, and to age 50 in civil cases.

It would also establish a one-year window for past victims to come forward with a civil suit, even if the statute has expired.

Other versions eliminated the statute of limitations altogether.

Erie County District Attorney John Flynn says state senators are likely stalling because they disagree with the civil portion of the bill.

"Anytime you deal with the civil aspect, you're talking about money. And anytime you're dealing with money, you're going to have institutions out there who are concerned about being sued for an act that occurred 30, 40, 50 years ago,” said Flynn. “Deal with the criminal part right now by itself and then worry about the civil part later on."

The Erie County Legislature will vote on a resolution Thursday that also calls on the senate to take action.

They'll be sending copies of it to the state Senate and Assembly and Gov. Cuomo.
