BUFFALO, N.Y. — A Cheektowaga man will spend the next six years in prison for hitting a teenager with his vehicle while driving drunk and leaving the scene.

Paul Hintermeir, 37, was sentenced in Erie County Court Tuesday morning.

The crash happened last August, when Hintermeir was driving with a blood alcohol level twice the legal limit. Damian Garra was riding his bicycle on Shanley Street when he was hit. He later died from his injuries.

Hintermeir pleaded guilty to vehicle manslaughter and leaving the scene of a deadly accident in January. He was originally charged with DWI, vehicular assault and leaving the scene of an accident resulting in personal injury, but the charges increase when Garra died.

Garra’s mother and girlfriend spoke before the sentencing, asking the court to impose the maximum sentence of seven years. Both the Erie County District Attorney and Garra’s family said even seven years wouldn’t be enough.

“He was driving drunk, he was driving recklessly and he fled from the scene of an accident and now he only faces a max of seven years? That seems a little light,” said Erie County District Attorney John Flynn.

He added that he believes the punishment for vehicular manslaughter doesn’t have the “teeth” to provide justice for families like the Garras. Instead, Flynn said he thinks a maximum sentence of 10 to 15 years would be more appropriate.
