BUFFALO, N.Y. — Nearly two months after 17-month old Kyrie Johnson and his grandmother 54-year old Yvette were shot and killed here on Grape Street, Erie County district attorney John Flynn says 25 year-old Kenyatta Austin is responsible for the senseless shooting.

"He was arraigned on two counts of intentional murder, one for the grandmother and one for the grandson,” Flynn said. “He was also arraigned on a separate legal theory of homicide which is the high crime of murder by depraved indifference.”

Austin also faces assault charges, reckless endangerment and gun possession charges. Flynn says Austin was charged after he was arrested in Niagara Falls on a gun charge on July 3, one day after the deadly shooting.

He says it was tips from the public that led them to Austin.

“I know that there's been a narrative out there that this was such a horrific crime that people have said 'enough's enough.’ And they're coming forward now because an infant and a grandmother got killed," said Flynn.

Flynn's says there were others involved in the shooting and they're asking for people to continue to come forward with information.

"It was vital the tips that we received to put this case where it is at today. We're not done,” said Buffalo Police Department Deputy Commissioner Joseph Gramaglia. “We still need people to come forward. We're hoping people see that there was an arrest made here and now will feel even more comfortable coming forward and talking to us. So, we're asking people to come talk to us.”

Austin is being held without bond pending his next court date. Flynn said if convicted he could receive 64 years to life in prison.
