WARSAW, N.Y. — A retired Wyoming County Sheriff's Sergeant was arraigned Wednesday in connection with a fatal shooting.

Joseph Mylniec, 60, pleaded not guilty this morning to charges of second-degree murder and intimidating a witness or victim.

Mylniec is accused of fatally shooting 32-year old Robert Irvine III in early March.

Investigators say Mlyniec shot Irvine four times in the driveway of his home on Route 246 in the town of Perry. Police say he used a 45-caliber handgun. Mlyniec then called 911 to report the shooting.

The sheriff has not given details on a motive, but does say the men knew each other. Court paperwork alleges Mlyniec intentionally attacked Irvine for the purpose of obstructing or delaying Irvine from communicating information about allegations of sexual abuse to officials.

Mlyniec is being held without bail.

He is scheduled for his next court appearance June 21.
