It was a surprising day in court as the man accused of killing a Binghamton University student rejected a plea deal on a second-degree murder charge against him.

Mike Roque was expected to plead guilty for the stabbing death of Joao Souza on the BU campus back in April.

Defense lawyer David Butler appeared shocked, saying he had already talked to his client's family about the deal.

The Massapequa, New York native will now stand trial on September 24.

If convicted, he faces 25 years-to life in prison.
