The case against a man accused of hitting a state trooper with his car in Binghamton is heading to trial. 

James Giacalone rejected a plea to attempted aggravated assault upon a police officer Friday morning, which would have carried a sentence of 12 years. 

Giacalone is facing five counts, including attempted murder.

Officials say he was trying to avoid arrest on an active warrant, when he rammed into one trooper and nearly hit a second.

One of the troopers shot Giacalone in the face before he was captured. Giacalone was released from the hospital a week later.

As for the injured trooper, he was treated and released from the hospital.

The Broome County's District Attorney says the state trooper who fired his weapon was justified in his actions.

The trial is set for Monday morning.
