Opening statements were made Tuesday in the murder trial of Marquis McKinney.

McKinney is accused of killing Devoshay Adams at a Halloween party in Elmira last year.

The prosecution claims three witnesses say they saw someone who they believed to be the defendant shoot Adams.

Investigators also recovered a shell casing from the scene.

But the defense argues it was dark at the party, so it could have been someone else. They also say the witnesses' memories could be inaccurate given the time between the incidents, the trial, and that McKinney was not there at the time of the shooting.

McKinney is facing a 2nd degree murder charge and testimonies continue on Wednesday.
