CARY, N.C. -- The death of a 6 month old baby in Cary has been ruled accidental by the State Medical Examiner's Office.

The baby's mother still faces jail time.

Myechia Avery, 30, was in court Tuesday. She's charged with involuntary manslaughter and child abuse.

Her son, Benjamin, was found unresponsive under a plastic bag on September 18.

The 6 month old later died at the hospital.

Autopsy reports reveal the infant died of being under the plastic bag.

Since the autopsy revealed no other trauma to the child, the death was ruled as accidental.

If Avery is convicted, she could spend up to seven years in prison.

She is set to appear in court again next month.
