CHAPEL HILL, N.C. -- A man accused of punching a UNC student at a Silent Sam rally in August will not serve any jail time.

During the rally, a student is seen in video trying to grab Bary Brown's flag. Brown says the man got too close to his flowers he had ready to lay at Silent Sam's memorial and that's when Brown punched him in the face.

Police charged him with assault.

This was one of many rallies after Silent Sam was toppled in August. At least seven people were arrested or given a citation during it.

On Monday, an Orange County judge found Brown guilty but says he won't have to face any jail time, and will not have to pay any money.

Despite no charges, Brown is asking for an appeal.

Some in the courtroom say they're concerned with no punishments, and say Brown will go out and assault someone again.

The student who was assaulted declined to comment.
