RALEIGH – A man is dead in after a car struck a home in Raleigh early Friday morning

Police say it happened just after midnight in the 800 block of East Lenior Street between Quarry and Church streets.

They say an officer was passed by a vehicle traveling at a high rate of speed. The officer tried to stop the car on Martin Luther King Jr. Boulevard but the driver, 19-year-old Etgar Edvardo Bautista-Montoya, fled.

The officer did not persue per police departmental policy.

Bautista-Montoya failed to stop at the stop sign located at State Street and Lenoir Street and struck the home. 

The crash killed a man who was inside the home, 42-year-old Anthony Gaines.

Two children were also inside the residence but neither was seriously injured.

Bautista-Montoya suffered minor injuries.

He's been charged with felony death by vehicle and driving while impaired.

Police say two juveniles were inside the vehicle at the time of the crash. They were not injured.
