CHARLOTTE, N.C. -- There's now a double investigation into who is responsible for dumping portable toilet water near Mallard Creek.

A pool of bright blue water was found on PNC Music Pavilion's property earlier this week and Charlotte-Mecklenburg Storm Water Services is looking into the matter along with the state Division of Water Resources.

The company the Pavilion contracts for the toilets, A-Sani-Can, helped pump out 5,500 gallons of waste and creek water, but denies any dumping.

"The blue material is used by a number of different companies. Being able to pinpoint who put it there is very difficult process," said Rusty Rozzelle, Water Quality Program Manager for Storm Water Services. 

No word yet on fines, but Rozzelle explained it could be a violation of a surface water pollution control ordinance. It could carry a max penalty of $5,000 per day, per violation.

Calls and emails to Live Nation, PNC Music Pavilion's parent company, and A-Sani-Can have gone unanswered.
