CHARLOTTE -- The defense has rested in the Gregory Wheeling trial in Charlotte.

Wheeling is accused of causing the death of Kelli Putnam by driving drunk, speeding and hitting her on South Boulevard in January.

On Friday morning, Wheeling declined to testify on his own behalf.

The defense called just one witness to the stand, an EMT who responded to the crash, before the jury was sent home until Monday.

Wheeling is charged with second degree murder, aggravated felony assault with a vehicle and DWI.

The judge will now allow the jury to consider involuntary manslaughter as a lesser charge in place of second degree murder.

The defense also wants the judge to give a special instruction to the jury to consider Putnam’s contribution to causing the accident.

The defense has called witnesses claiming they saw Putnam run onto South Boulevard. Others saying she stepped of the curb without looking for oncoming traffic.

The prosecution contends the accident could have been prevented by Wheeling going the speed limit.

Experts estimate wheeling drove anywhere from 16 to 32 miles above the speed limit.

A blood test also shows wheeling had 0.13 blood alcohol content the night of the crash. 

The jury is dismissed until 10 a.m. Monday which is when closing arguments could begin.
